Terms And Conditions of Sale

These terms and conditions (“Ts&Cs”) are a contract between you and the person identified as “We, us, our” in the Schedule (“we”, “us”, “our”). If you are under the age of 18, a parent or guardian must read and agree to these Ts&Cs for you and a reference to “you” means you and your parent/guardian, as applicable. 

These Ts&Cs apply when you buy products and/or services from us. Please read them carefully together with any other rules or guidelines that are posted onto our Website or otherwise notified to you from time to time. These Ts&Cs and the rules/guidelines are together referred to as the “Terms”. 

 

1. CONFIDENTIALITY

 All of the personal information gathered by the Dietitian during the provision of the service will remain confidential and secure except where:

1. It is subpoenaed by a court, or

2. Failure to disclose the information would place you or another person at serious and imminent risk; or

3. Your prior approval has been obtained to:

a) provide a written report to another professional or agency .e.g. a GP or a specialist.

b) discuss the material with another person, e.g. a parent

Or if disclosure is otherwise required or authorised by law.

 

2. FEES STRUCTURE

Fees for this practice are based on the attached schedule unless otherwise negotiated.

The Agreed Payable Fees determined prior to your appointments are:

Individual Consultation: $250 per 1:1 SOS intensive session (approx. 50min)

 

3. CANCELLATION POLICY:

Last minute cancellations have an impact on three parties:

(1) The client who delays their progress,

(2) Another client sitting on the waitlist who misses the chance for an appointment, and

(3) The Dietitian who has spent time preparing for the session.

If you need to cancel or postpone your appointment, please provide at least 24 hours' notice.

For cancellations made within 24 hours, your appointment will be forfeited. Late cancelations may mean you may not be able to fit all of your appointments in by the end of your 12-week period - meaning you may have to forfeit an appointment at your own expense.

 

4. CONSENT TO STORE INFORMATION

I consent for my practitioner to collect, store and utilise this personal information for the purposes of providing services to me in accordance with the relevant privacy legislation and any other legal requirements that may apply.

I have read and understand the above information and agree to abide by these cancellation conditions.

5. LIABILITY

Any other products or services (not created by Kimberley) that are recommended, provided or endorsed by the practitioner/ package / program are at your own risk of injury or adverse effects. It is recommended that if you choose to engage in "workouts" provided by other practitioners is at your own risk / liability - so to do them to your own sense of ability.

I understand and agree to my own risk / liability of engaging in physical activity workouts provided by outside practitioners. OR will seek individualised advice from a qualified personal trainer or exercise physiologist in my own time for activity to my own ability level:
